Mediation has been and continues to be a highly successful process in resolving matters privately.
Mediation is a confidential meeting or series of meetings, where an independent, neutral third party (known as the Mediator) facilitates discussion between people in a dispute with the aim to assist those people to negotiate and reach agreement.
The Mediator acts as a catalyst to canvass issues and ideas, utilising their skills and experience to help people reach agreement by identifying the relevant issues, exploring solutions and outlining the consequences of a matter not settling.
It is important to understand that the Mediator cannot impose their own decision upon the participants to the mediation, with the mediators role being one of independence and impartiality. Agreements reached in mediation are not legally binding until the agreement is then recorded in either a Consent Order, Financial Agreement or other binding legal document.
